1. Scope and Acceptance

These Terms of Service ("Terms") govern your access to and use of the KasLens application, the website kaspa-lens.com, and any related services (collectively, the "Services"). The Services are operated by:

By accessing, registering for, or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Services.

These Terms constitute a legally binding agreement between you and the operator within the meaning of §§ 145 ff. BGB (German Civil Code).

2. Description of the Services

KasLens is a cryptocurrency market analytics and information platform. The Services provide:

  • Market data, charts, and analytics for the Kaspa blockchain ecosystem
  • Token listings, wallet tracking, and address analytics
  • AI-generated market summaries and daily pulse reports
  • Market analysis models and market meter indicators
  • Wiki content and educational materials about blockchain technology
  • Push notifications for market events (mobile app)

The Services are provided "as is" and "as available." We reserve the right to modify, suspend, or discontinue any part of the Services at any time without prior notice.

3. Disclaimer — No Financial or Investment Advice

IMPORTANT: THIS SECTION CONSTITUTES A MATERIAL PART OF THESE TERMS.

The KasLens application and all related Services are for informational and educational purposes only.

KasLens is a market insight and analytics tool. It is not a financial advisor, investment advisor, securities broker, or any other kind of financial services provider. The operator does not hold any license under the German Banking Act (Kreditwesengesetz, KWG), the German Securities Institutions Act (Wertpapierinstitutsgesetz, WpIG), or the German Payment Services Supervision Act (Zahlungsdiensteaufsichtsgesetz, ZAG), nor does the operator require such a license for the Services provided.

In particular:

  • No investment advice (keine Anlageberatung): The content, data, forecasts, charts, analysis, AI-generated summaries, market analysis models, market meter indicators, and any other information provided through the Services do not constitute investment advice within the meaning of § 2 Abs. 8 Nr. 10 WpHG (German Securities Trading Act) or any equivalent regulation. Nothing in the Services should be construed as a personal recommendation to buy, sell, or hold any cryptocurrency, token, or other digital asset.

  • No financial advice (keine Finanzberatung): The Services do not constitute financial advice, trading advice, tax advice, legal advice, or any other sort of professional advice. You should consult a qualified professional advisor before making any financial decisions.

  • No prospectus or offering: The Services do not constitute an offer to sell, a solicitation of an offer to buy, or a recommendation of any cryptocurrency, token, security, or other financial instrument. Nothing in the Services constitutes a prospectus within the meaning of the EU Prospectus Regulation (Regulation (EU) 2017/1129) or the German Securities Prospectus Act (Wertpapierprospektgesetz, WpPG).

  • No suitability or appropriateness assessment: KasLens does not assess the suitability or appropriateness of any investment for your individual circumstances, financial situation, investment objectives, risk tolerance, or knowledge and experience. Any information provided through the Services is generic and not tailored to your personal situation.

  • AI-generated content disclaimer: Some content in the Services (including daily pulse summaries, market analysis models, and analytical estimates) is generated by artificial intelligence systems. AI-generated content may contain inaccuracies, errors, or outdated information. Such content is explicitly not a substitute for professional human analysis or advice.

4. Risk Warnings

Cryptocurrency investments carry a high degree of risk.

You acknowledge and agree that:

  1. Volatility: Cryptocurrency markets are highly volatile. The value of any cryptocurrency or token can fluctuate significantly within short periods. Past performance is not indicative of future results.

  2. Total loss risk (Totalverlustrisiko): You may lose some or all of the money you invest. You should only invest money that you can afford to lose entirely.

  3. Regulatory risk: Cryptocurrencies are subject to evolving regulatory frameworks in Germany, the EU, and internationally. Changes in regulation (including under MiCAR — the EU Markets in Crypto-Assets Regulation) may adversely affect the value, use, or legality of certain digital assets.

  4. Technology risk: Blockchain technology and smart contracts may contain bugs, vulnerabilities, or design flaws that could result in the loss of funds. KasLens is not responsible for any technical failures of third-party blockchain networks, exchanges, or protocols.

  5. Data accuracy: While KasLens strives to provide accurate and timely data, we do not guarantee the accuracy, completeness, or timeliness of any information displayed. Market data is sourced from third-party exchanges and blockchain APIs that may experience delays, outages, or errors.

  6. Your responsibility: You alone are responsible for evaluating the merits and risks of using any information from the Services before making decisions. You agree not to hold KasLens or its operator liable for any claim for damages arising from any decision you make based on information from the Services.

5. Permitted Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the Services in any way that violates applicable local, national, or international law or regulation, including but not limited to EU regulations and German federal and state laws
  • Use the Services for money laundering, terrorist financing, or any other illegal activity
  • Attempt to reverse-engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Services
  • Use automated systems, bots, or scraping tools to access the Services without prior written permission
  • Circumvent rate limits, access controls, or other technical restrictions
  • Interfere with or disrupt the integrity or performance of the Services
  • Impersonate any person or entity or falsely represent your affiliation with any person or entity
  • Create multiple accounts for the purpose of circumventing bans or restrictions
  • Use the Services to provide competing financial data or analytics services without permission

6. User Accounts

6.1. Registration

To access certain features of the Services, you may need to create an account. When registering, you agree to:

  • Provide accurate and complete information
  • Maintain the confidentiality of your login credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately if you suspect unauthorized use of your account

6.2. Minimum Age

You must be at least 16 years old to create an account. If you are under 18, you should have your parent or legal guardian review these Terms with you.

6.3. Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in any activity that is harmful to the Services or other users. You may delete your account at any time from the Account page in the application.

7. Intellectual Property

7.1. Our Content

The software, design, layout, original text, graphics, logos, and icons created by the operator are the property of the operator and are protected by German copyright law (Urheberrechtsgesetz, UrhG), EU copyright directives, and international intellectual property treaties.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the operator's original material without prior written consent, except as permitted for personal, non-commercial use.

7.2. Third-Party Content

The Services display content sourced from third parties, including but not limited to market data from cryptocurrency exchanges, blockchain network data, token logos and images, embedded videos (e.g. YouTube), and news feeds. Such third-party content remains the intellectual property of its respective owners. The operator does not claim ownership of third-party content and displays it under applicable licenses, API terms of service, or fair use principles. Your use of third-party content is subject to the respective rights holders' terms.

8. Limitation of Liability

8.1. General

To the fullest extent permitted by applicable law, the operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with the use of or inability to use the Services.

8.2. German Law Liability Framework

In accordance with German law, the operator's liability is limited as follows:

  • Intent and gross negligence (Vorsatz und grobe Fahrlässigkeit): The operator is fully liable for damages caused intentionally or through gross negligence (§§ 276, 277 BGB).
  • Slight negligence (einfache Fahrlässigkeit): In cases of slight negligence, the operator is liable only for the breach of material contractual obligations (Kardinalpflichten) — obligations whose fulfilment is essential for the proper performance of the contract and on whose compliance the contractual partner regularly relies. In such cases, liability is limited to the foreseeable, typically occurring damage (vorhersehbarer, vertragstypischer Schaden).
  • Liability for injury to life, body, or health: The above limitations do not apply to liability for injury to life, body, or health (§ 309 Nr. 7a BGB).
  • Product liability: Liability under the German Product Liability Act (Produkthaftungsgesetz, ProdHaftG) remains unaffected.

8.3. No Liability for Third-Party Content

The operator is not liable for the accuracy, reliability, or completeness of data sourced from third-party exchanges, blockchain networks, or other external providers. The operator is not liable for any damages arising from the use of third-party services linked from the Services.

9. Indemnification

You agree to indemnify, defend, and hold harmless the operator from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any investment decisions you make based on information from the Services

10. Dispute Resolution

10.1. Applicable Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-law provisions.

10.2. Jurisdiction

For disputes with merchants (Kaufleute), legal persons under public law, or public-law special funds, the exclusive place of jurisdiction is Hamburg, Germany.

10.3. Consumer Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) pursuant to § 36 VSBG (Verbraucherstreitbeilegungsgesetz).

11. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely reflects the original intent (§ 306 BGB).

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Services (e.g., a banner on the website or a notification in the app). Your continued use of the Services after such changes constitutes acceptance of the modified Terms.
